Under the current labor laws of the United States, undocumented workers are entitled to the protections provided in the Fair Labor Standards Act (FLSA). That means that if you are, or were, an undocumented worker, and have been paid less than minimum wage, or have not been paid overtime pay you have earned, you may be entitled to back pay if your employer is found guilty of the violation. Your undocumented worker status may not be raised as a point of defense by the employer who owes you money.
